§ 1 Scope and parties
(1) These General Terms and Conditions, in the version applicable at the time an order is placed, govern the relationship between APA Intemporal UG, Bernauer Straße 31, 10115 Berlin, Germany (the “Seller”) and the customer (the “Customer”) for purchases in the online store at apa-intemporal.com and its checkout at checkout.apa-intemporal.com (the “Online Store”). The Customer can read, save and print these terms at any time from the links in the Online Store. The terms applying to an order are also sent with the order confirmation on a durable medium (e-mail).
(2) Customer service for the Online Store is provided by APA Intemporal UG, info@apa-intemporal.com.
(3) The Online Store is aimed at consumers of legal age with a delivery address in one of the countries offered at checkout. A consumer is any natural person acting for purposes which are wholly or mainly outside their trade, craft or business.
§ 2 The order process
(1) The products in the Online Store are an invitation to the Customer to make an offer to buy.
(2) The Customer selects items with “Add to cart” and reviews them in the cart. By completing the checkout and clicking the final order button, the Customer makes a binding offer to buy the items in the cart (the “Order”).
(3) Goods are delivered in quantities usual for private households. For business enquiries please contact info@apa-intemporal.com.
(4) Before placing the Order, the Customer can view and change its contents at any time in the cart and at every step of the checkout.
(5) After the Order is placed, the Customer receives an automatic acknowledgment by e-mail with a summary of the Order. This acknowledgment is not yet an acceptance of the offer.
(6) A binding contract is concluded when the Seller accepts the Order. The Seller may accept within 7 days of receipt and does so by sending the dispatch confirmation by e-mail (the “Contract Confirmation”).
(7) Where an Order contains several items, a contract is concluded only for the items named in the Contract Confirmation.
(8) This also applies where the Customer has already paid. If no contract is concluded, the Seller informs the Customer by e-mail and refunds the payment without delay.
(9) The Customer’s statutory right of withdrawal (§ 7) is unaffected.
(10) The contract is concluded in English. The Seller stores the contract text (Order, these terms and the Contract Confirmation) and sends it to the Customer.
§ 3 Delivery, delivery times, availability
(1) Goods are delivered to the delivery address given in the Order, to the countries offered at checkout. Orders ship from Berlin with a tracked carrier. Unless stated otherwise on the product page or at checkout, delivery takes 2 to 4 business days within the European Union and 5 to 10 business days elsewhere, counted from the Contract Confirmation and subject to availability.
(2) When the parcel is handed to the carrier, the Customer receives the dispatch confirmation with a tracking link.
(3) If the Seller cannot meet a binding delivery date for reasons outside its control (for example a supplier’s failure to deliver, or force majeure), it informs the Customer without delay and names a new expected date where possible. If the new date is unacceptable to the Customer, or the goods are not available at all, either party may withdraw from the contract for the goods concerned; payments already made are refunded. Statutory rights remain unaffected.
§ 4 Returns and exchanges
(1) Beyond the statutory right of withdrawal (§ 7), the Customer may return or exchange any item within 14 days of receiving it, without giving a reason. Items must be unworn, undamaged, clean and with the original hang tag attached.
(2) To return or exchange, write to info@apa-intemporal.com. Returns are accepted only with a return label issued by the Seller. An exchange item is sent after the returned item has been received and inspected; exchanges depend on available stock, and the Seller will offer an alternative size or colour where the requested one is sold out.
(3) The Seller may refuse a return or exchange, or charge a reconditioning fee, where an item comes back worn, damaged, altered, washed or without its hang tag.
§ 5 Prices, promotions and delivery charges
(1) All prices on the website include the applicable statutory value-added tax.
(2) Delivery charges, and any duties or taxes for destinations outside the European Union, are shown at checkout before the Order is placed and are borne by the Customer. Delivery charges depend on the destination country.
(3) During a promotion the reduced price shown applies for the period stated on the website; the price struck through is the Seller’s regular price before the promotion. Promotional gifts, such as a travel pouch offered free with a coat, are limited to one per Order, are available while stocks last, and are not exchangeable for cash. Where an Order with a free gift is returned in full, the gift is to be returned with it.
§ 6 Payment
(1) The Seller accepts only the payment methods shown at checkout, currently credit and debit cards, PayPal and the other methods offered there.
(2) To protect itself against the risk of default, the Seller may exclude certain payment methods in individual cases.
(3) Card payments are charged when the Order is completed.
§ 7 Right of withdrawal
(1) Consumers within the meaning of § 13 BGB (German Civil Code) have a statutory right of withdrawal for goods bought at a distance. We inform you about this right as follows:
Instructions on withdrawal
Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, take possession of the goods (for an Order delivered in several parcels, of the last parcel). To exercise the right of withdrawal, you must inform us, APA Intemporal UG, Bernauer Straße 31, 10115 Berlin, Germany, info@apa-intemporal.com, +49 176 4583 9976, of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an e-mail). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline it is sufficient to send your notice before the withdrawal period has expired.
Effects of withdrawal. If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (except any additional costs resulting from your choice of a delivery type other than the least expensive standard delivery we offer), without undue delay and in any event not later than 14 days from the day on which we are informed of your withdrawal. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is the earliest. You shall send back the goods to APA Intemporal UG, Bernauer Straße 31, 10115 Berlin, Germany, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal to us. The deadline is met if you send the goods before the 14 days have expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

(2) The Customer may also exercise the right of withdrawal by returning the goods within the withdrawal period; no separate declaration is then needed. The Customer bears the direct cost of the return.
§ 8 Warranties
The Customer has the statutory rights for defective goods under German law: goods must be of the agreed quality, fit for their purpose and match their description in the Online Store, and defective goods are repaired, replaced or, where that fails, the price reduced or the contract rescinded. Nothing in these terms limits those rights. Each coat also comes with the Seller’s own guarantee as described on the Help page; it is in addition to the statutory rights.
§ 9 Liability
(1) The Seller is liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and for guarantees it has given.
(2) For simple negligence the Seller is liable only for breach of an essential contractual obligation (one whose fulfilment makes the contract possible and on which the Customer may rely), and then only for the foreseeable damage typical of the contract.
(3) These limitations also apply to the Seller’s legal representatives and agents.
§ 10 Law and jurisdiction
(1) These terms and the contracts under them are governed by German law; the UN Convention on Contracts for the International Sale of Goods (CISG) does not apply. For consumers, the mandatory consumer protection provisions of the country of their habitual residence remain applicable.
(2) The contractual language is English.
(3) The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. The Seller is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
§ 11 Discount codes
(1) Unless expressly stated, discount codes cannot be combined with each other.
(2) Discount codes cannot be applied to items already reduced in a promotion, unless the promotion says otherwise.
§ 12 Crowdfunding backers
These terms apply to purchases made and paid in the Online Store. Rewards from the Kickstarter, Indiegogo and Makuake campaigns are governed by the terms of the respective platform. For those rewards the Seller offers exchanges by arrangement (info@apa-intemporal.com), subject to stock, with the backer bearing the shipping costs both ways and the risk of the return shipment; items must be unworn, undamaged and with the hang tag attached. The statutory right of withdrawal does not apply to crowdfunding rewards.
